Course Overview – Introduction

The Product Governance regime came into effect on the 3rd of January 2018 as part of the Markets in Financial Instruments Directive and Regulation, known as MiFID II. The new regime aims to ensure that firm’s act in a client’s best interests, including funds and related management services, to end clients.

The Product Governance regime ensures that when a firm manufactures or distributes regulated financial services and products, it has arrangements in place to understand the products and only sold to investors and clients for which they are likely to be deemed suitable. The requirements apply to “services” as well as “products”, for all client types and to all distributors in the sales chain.

This seminar will provide delegates with an overview of the regulatory requirements and assess what these requirements practically mean for firms.

 

Learning Objectives – What you will learn 

This course will cover the following:

  • Clarify fundamental regulatory principles that firms should review concerning the product governance framework, including governance; management oversight; roles & responsibilities; and process.

  • State the product approval obligation on firms acting as manufacturers, distributors and intermediaries.

  • Analyse the practical considerations for investor protection, including target market; fair value; customer needs; and terms and processes.

  • Examine critical issues concerning reputational risk including operational risk, a lack of transparent policies, procedures and processes; and

  • Identify possible elements and controls which improve the quality of a firms oversight of product governance.

Who is Vivienne Bannigan

Vivienne is a financial services professional with over 20 years’ experience in regulatory and operational risk in the United Kingdom, Europe and internationally. Vivienne has held various roles across several organisations including the Financial Conduct Authority (FCA), Royal Bank of Scotland and UK Finance. Vivienne has worked in wholesale policy covering the Market Abuse Regime, Markets in Financial Instruments Directive (I & II), Securities lending, Client Money , Transaction Reporting and mentoring her colleagues along the way. Vivienne designed and implemented training and communications to support programme delivery, including the Markets in Financial Instruments Directive and Client Money and Assets. Vivienne holds various qualifications including an M. Econ. Sc. in European Economics and Public Affairs. Vivienne is an accredited Dispute Resolution Mediator and is completing an MA in Community Psychology at the University of Brighton. Vivienne is passionate about sailing and supporting individuals to achieve their potential while at the same time, creating an environment that is professional, practical and participative.
